BUGTA

What is BUGTA?

Elsewhere, we have noted that ‘most’ bodies corporate in Queensland are regulated by the Body Corporate and Community Management Act 1997 (‘BCCMA’) (and associated regulation modules). However, there are a small number of schemes regulated by different legislation, most notably the Building Units and Group Titles Act 1980 (abbreviated to ‘BUGTA’).

BUGTA was the predecessor to the BCCMA and, whilst most existing schemes under BUGTA were transferred to the BCCMA regime upon its commencement in 1997, a number of specified schemes were excluded from the transition and continue to be regulated by BUGTA.

Our lawyers have experience in the BUGTA regime and can advise bodies corporate, committees, owners, and all stakeholders with an interest in these schemes of the applicable legislative requirements, governance structures and arrangements, and the resolution of disputes.
