FAMILY DISPUTE RESOLUTION

Under Australian Family Law you are strongly encouraged to reach agreement as to both property disputes and parenting issues prior to going to court. This is known as Family Dispute Resolution, which is a form of organised mediation.

If you are seeking parenting orders then Family Dispute Resolution is compulsory, unless you can satisfy one of the following:

You are applying for Consent Orders (that is, you have already reached an agreement);
You are the respondent in the proceedings;
The matter is urgent;
There has been, or is a risk of, family violence or child abuse;
A party is unable to participate in Family Dispute Resolution effectively i.e. due to incapacity; or
A party has contravened Court Orders and shown serious disregard to a Court Order made in the preceding 12 months.

After engaging in Family Dispute Reolution you are still not able to agree, you will be granted a Certificate, and this must be obtained prior to commencement of proceedings, except as outlined above.
